1. Acceptance of Terms

These Terms of Use (the “Terms”) form a legally binding agreement between you and Success Tutoring Online (“Success Tutoring Online,” “we,” “us,” or “our”). They govern your use of our website at successtutoringonline.com (the “Site”), our online tutoring services (the “Tutoring Services”), and our Math Facts Practice Game (the “Game”), together with any related content, features, and purchases (collectively, the “Services”).

By accessing the Site, requesting or receiving Tutoring Services, or purchasing or using any product, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy, which is incorporated here by reference.

If you do not agree to these Terms, do not use the Site, request tutoring, or purchase any product or service from us.

2. Eligibility and Minors

To create an account, submit personal information, or make a purchase on the Site, you must be at least 18 years of age and able to enter into a binding contract, or you must be a parent, guardian, or teacher acting on behalf of a minor.

Most of our students are minors. Tutoring Services for any student under 18 must be requested, authorized, and paid for by a parent, guardian, or other authorized adult, or by an approved charter school on the family’s behalf. That adult accepts these Terms on behalf of the student and is responsible for the student’s use of the Services.

We do not knowingly collect personal information directly from children under 13 without verifiable parental consent. A parent or guardian provides any information needed to arrange tutoring for a child under 13 and consents to that child’s participation. Children under 13 may use the Math Facts Practice Game only under the supervision of a parent, guardian, or teacher.

Our Tutoring Services are offered to students located in the United States. We schedule sessions based on United States time zones and do not provide live tutoring outside the United States.

3. Website Use and Acceptable Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial purposes and to learn about and arrange our Services. You agree to use the Site lawfully and not to:

• attempt to gain unauthorized access to any part of the Site, accounts, or systems;
• interfere with, disrupt, or compromise the Site or its security;
• scrape, copy, harvest, or republish content except as expressly permitted;
• upload or transmit viruses, malware, or other harmful code;
• impersonate any person or misrepresent your affiliation with anyone; or
• use the Site to harass, threaten, or harm any person.

Some features, including online whiteboard sessions, may require login details or an access link. You are responsible for keeping these credentials confidential and for activity that occurs under them, and you agree to notify us promptly of any unauthorized use.

4. Automated Access and AI Training

You may not access the Site using automated means, such as bots, crawlers, or scrapers, except for legitimate search engine indexing that follows the instructions in our robots.txt file. You may not bypass or attempt to bypass any measure we use to manage or limit automated access.

You may not use any content on the Site, including tutoring materials, text, images, and the Math Facts Practice Game, to develop, train, or improve any artificial intelligence or machine learning model, or for text or data mining, without our prior written permission. We expressly reserve all rights in our content against these uses to the fullest extent permitted by law.

We may use AI-assisted tools to help operate, secure, and improve our Services and to support our educators. Our experienced educators remain responsible for the instruction they provide.

5. Cookies and Tracking Technologies

Our website uses cookies and similar technologies, such as pixels and tags, to operate the Site, remember your preferences, measure performance, and support marketing. This includes analytics and advertising services provided by third parties such as Google, for example Google Analytics and Google Ads, and Meta Platforms, for example the Facebook pixel.

6. Tutoring Services

What we provide

Success Tutoring Online provides one-to-one online tutoring delivered by experienced educators. We primarily serve students in grades 3 through 12, and we also support college undergraduates in math and science. Subjects include reading, writing, grammar, math at all levels, science, chemistry, calculus, AP English, foreign languages, and test preparation such as HSPT, SAT, and ACT, among others. The availability of a given subject, level, or educator may vary.

Scheduling and sessions

Sessions are scheduled by mutual arrangement and delivered online, including through our whiteboard platform. You are responsible for having a reliable internet connection and a suitable device for each session.

Parent and guardian responsibilities

For students who are minors, a parent or guardian is responsible for arranging sessions, supervising the learning environment as appropriate, ensuring the student attends scheduled sessions, and communicating any needs or concerns to us.

Charter school arrangements

Success Tutoring Online is an approved vendor for a number of charter schools. If your student is enrolled through a charter school, tutoring may be arranged, authorized, and paid for through that school under its own vendor and funding policies. Because each school sets its own rules, please confirm directly with your charter school how its program works, including any approval, budgeting, purchase order, or reimbursement requirements, before tutoring begins. Those policies apply in addition to these Terms. We are always glad to work within an approved arrangement, but coordinating funding and budgeting with the school remains the family’s responsibility, and Success Tutoring Online is not responsible for the individual policies or funding decisions of any particular school.

Fees and payment for tutoring

Fees for Tutoring Services are quoted to you before services begin and may depend on subject, level, session length, and frequency. Unless your tutoring is arranged through a charter school, you authorize us to charge your chosen payment method for the tutoring you request.

Cancellations, rescheduling, and missed sessions

Please provide advance notice if you need to cancel or reschedule a session. To cancel or reschedule, notify us at least 24 hours before the scheduled session. Sessions canceled with less than 24 hours’ notice, and sessions a student does not attend, may be charged in full. We will make reasonable efforts to reschedule when adequate notice is provided.

No guaranteed results

Our educators work hard to help every student succeed, and we are committed to results. We do not, however, guarantee any specific grade, test score, admission, placement, or other educational outcome. Outcomes depend on many factors outside our control, including each student’s effort, attendance, and individual circumstances.

Conduct and recordings

We expect students, parents, and guardians to treat our educators with respect, and we hold our educators to the same standard. We may decline or discontinue service for conduct that is abusive, unsafe, or disruptive. Sessions may be recorded for quality, training, and safety purposes. Any recordings are handled in accordance with our Privacy Policy.

7. Math Facts Practice Game

Free trial (10 plays)

Visitors may access the Game for up to 10 plays at no charge, with no account or purchase required. After 10 plays, continued access requires a purchase.

Full access (180-day license)

When you purchase full access, you receive unlimited use of the full Game for 180 days from the date of purchase. Access is delivered by email as an access code and a link to the full game page. The following terms apply to full access:

• The 180-day period begins on the date of purchase and cannot be paused or extended.
• Access is granted for personal, non-commercial use only.
• The access code is non-transferable and may not be shared for commercial purposes or distributed to anyone outside your immediate household or classroom.
• Classroom and multi-student use by a single licensed teacher or parent is permitted.

8. Pricing and Payment

All prices are listed in U.S. dollars. Payments are processed securely through our payment processor at the time of purchase. We accept major credit cards and other methods displayed at checkout. By completing a purchase, you authorize us to charge your payment method for the total amount shown.

9. Refunds

Tutoring Services

If you are not satisfied with a tutoring session, contact us promptly and we will work with you to make it right, which may include rescheduling or a credit toward a future session. Fees for completed sessions, and for sessions missed or canceled without the required notice, are generally non-refundable.

Math Facts Practice Game

Because the Game is a digital product, sales are generally final. Refund requests submitted within 7 days of purchase will be considered on a case-by-case basis. To request a refund, contact us at [email protected] or through our Contact page with your order number and the reason for the request. We may decline refund requests where the access code has already been used to access the full Game. If a technical problem prevents you from accessing the product, contact us and we will make it right.

10. Email and Communications

By contacting us or completing a purchase, you consent to receive communications related to your request, order, or sessions, including confirmations, scheduling messages, and access codes. You may also receive occasional promotional emails. You can opt out of promotional emails at any time using the unsubscribe link in any email or by contacting us. Opting out of promotional emails does not affect transactional or service-related messages.

11. Intellectual Property

All content on the Site, including the Math Facts Practice Game, tutoring materials, graphics, text, logos, and educational resources, is owned by Success Tutoring Online or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any of this content without our express written permission. Materials we provide for a student’s use are licensed for that student’s personal, non-commercial learning only.

12. Affiliate Products and Third-Party Links

We may from time to time recommend third-party products or services that we believe may benefit our families. Some recommendations may involve affiliate partnerships, meaning we may earn a commission if you make a purchase through our links. The Site may also link to third-party websites. We only recommend products and services we genuinely believe in, but we do not control and are not responsible for the content, quality, performance, or policies of any third party. Your dealings with third parties are solely between you and them.

13. Disclaimer of Warranties

The Site, the Tutoring Services, and the Game are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site or Game will be uninterrupted, error-free, or free of viruses or other harmful components, and we do not guarantee specific educational outcomes.

14. Limitation of Liability

To the fullest extent permitted by law, Success Tutoring Online and its owners, employees, and educators will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, the Tutoring Services, or the Game, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from the Services will not exceed the amount you paid us for the applicable product or service.

15. Indemnification

You agree to indemnify and hold harmless Success Tutoring Online and its owners, employees, and educators from any claims, losses, liabilities, and expenses, including reasonable attorneys’ fees, arising from your breach of these Terms or your misuse of the Site, the Tutoring Services, or the Game.

16. Governing Law and Dispute Resolution

These Terms of Use are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in California, and you consent to venue in those courts.

17. Changes to These Terms

We may update these Terms of Use from time to time. When we do, we will revise the “Last Updated” date at the top of this page. Your continued use of the Site or Services after changes are posted constitutes your acceptance of the revised Terms.
